These Terms of Service (“Terms”) govern your access to and use of the NakodaX website and any software, products, or services we make available (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

NakodaX provides software that lets you share source code, data and documents while retaining control over who may open them and for how long, including the ability to withdraw access after delivery. Features, availability and pricing may change; material changes will be reflected in these Terms or in your order form.

You must be at least 18 years old, or the age of legal majority in your jurisdiction, and have the authority to enter into these Terms on your own behalf or on behalf of an organization you represent.

You agree not to misuse the Service, including but not limited to: attempting to gain unauthorized access to our systems or other users’ data, reverse engineering or circumventing security or licensing controls, interfering with the normal operation of the Service, or using the Service for any unlawful purpose.

The Service, including all software, text, graphics, logos, and other content, is owned by NakodaX or its licensors and is protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the Service other than the limited right to use it as expressly permitted.

You retain ownership of any code, data, or content you submit to or process through the Service (“Customer Content”). You grant NakodaX a limited license to access and process Customer Content solely to provide and improve the Service. We will not use Customer Content for any purpose outside of delivering the Service without your consent.

Where the Service includes paid plans, applicable fees, billing cycles, and payment terms will be presented to you at the time of purchase or in a separate order form or agreement. Unless stated otherwise, fees are non-refundable except as described in our Refund Policy.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

To the maximum extent permitted by law, NakodaX shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service, even if advised of the possibility of such damages.

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms. You may stop using the Service at any time. Provisions of these Terms that by their nature should survive termination will continue to apply.

We may update these Terms from time to time. Material changes will be posted on this page with an updated revision date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

These Terms are governed by applicable law without regard to conflict-of-law principles, and any disputes arising from these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts.
